Introduction and Acceptance of Terms & Conditions
Welcome to Indus Cab, the premier transportation and mobility service provider in Ranchi, Jharkhand. These Terms and Conditions (“Terms,” “Agreement”) constitute a legally binding contract between you (the “User,” “Passenger,” or “Customer”) and Indus Cab (“Company,” “we,” “us,” or “our”).
This Agreement governs your access to and use of our website, mobile applications, digital booking platforms, customer support center, and the physical transportation services provided by our fleet and affiliated chauffeurs (collectively, the “Services”). By downloading our application, creating an account, booking a ride, or utilizing any of our Services, you unconditionally agree to be bound by these Terms. If you do not agree with any provision outlined within this document, you must immediately cease all use of our Services.
Service Overview and Scope
Indus Cab operates as a premium taxi and car rental agency facilitating point-to-point transportation, local city rentals, airport transfers (Birsa Munda Airport), railway station drops, and outstation travel across Eastern India.
-
Nature of Service: We provide a technology-enabled platform connecting passengers with professional, background-verified drivers operating well-maintained vehicles.
-
Service Availability: While we strive to provide continuous 24/7 service, operations are subject to vehicle availability, extreme weather conditions, traffic constraints, and unforeseen technological disruptions. We do not guarantee absolute availability at all times and locations.
-
Right of Refusal: Indus Cab reserves the right to refuse service to any individual at our sole discretion, particularly in scenarios involving suspected fraud, violation of these Terms, or threats to the safety of our drivers and fleet.
User Eligibility and Account Security
To utilize the premium services of Indus Cab, you must meet the following eligibility criteria:
-
Age Requirement: You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, to create an account and independently book a ride. Minors may only use our services when accompanied by a legally responsible adult.
-
Account Registration: When creating an account, you agree to provide accurate, current, and complete information, including your full name, mobile number, and email address.
-
Account Liability: You are solely responsible for maintaining the confidentiality of your login credentials. Any activity conducted under your account—including rides booked for third parties—is your legal and financial responsibility. You must notify us immediately if you suspect unauthorized access to your account.
Booking, Rescheduling, and Cancellation Policy
We understand that travel plans can change. To maintain the efficiency of our premium fleet, we have established the following booking and cancellation protocols:
-
Advance Bookings: Reservations for outstation travel, luxury car rentals, and airport transfers should ideally be made at least four (4) hours in advance to guarantee vehicle preference.
-
Cancellation by User: You may cancel a booking at any time. However, cancellations made within one (1) hour of the scheduled pick-up time for local rides, or within four (4) hours for outstation and premium rentals, may incur a cancellation fee. This fee compensates our chauffeurs for dispatched time and lost operational revenue.
-
No-Show Policy: If our chauffeur arrives at the designated pick-up location and the passenger fails to board the vehicle within fifteen (15) minutes (for immediate local dispatch) or thirty (30) minutes (for pre-scheduled airport/outstation bookings) without prior communication, the ride will be classified as a “No-Show.” The user will be liable for a No-Show penalty equivalent to the base fare of the requested vehicle category.
-
Cancellation by Indus Cab: We reserve the right to cancel any booking due to emergencies, severe weather, mechanical failures, or security concerns. In such rare instances, any advance payments will be fully refunded.
Fare Structure, Billing, and Payments
Indus Cab is committed to absolute transparency in its financial transactions.
-
Fare Calculation: The estimated fare provided at the time of booking is calculated based on base rates, estimated time, and distance. The final fare may fluctuate due to actual route changes, unexpected traffic delays, or passenger-requested deviations from the original itinerary.
-
Additional Charges: The base fare does not include toll taxes, state border permits (for outstation trips), airport parking fees, or waiting charges incurred during the journey. These out-of-pocket expenses are the sole responsibility of the passenger and will be added to the final invoice.
-
Payment Methods: We accept a variety of secure payment methods, including UPI, major credit/debit cards, digital wallets, and cash. Corporate clients utilizing our leasing services are subject to specialized invoice terms as outlined in their respective corporate agreements.
-
Surge Pricing: During periods of exceptional demand, heavy rainfall, or local festivals in Ranchi, dynamic pricing (“surge pricing”) may apply to ensure vehicle availability. You will always be notified of the applicable multiplier before confirming your booking.
Passenger Code of Conduct
To ensure a safe, hygienic, and premium experience for both passengers and chauffeurs, users must strictly adhere to the following behavioral standards:
-
Vehicle Cleanliness: Passengers must respect the cleanliness of the vehicle. Consumption of food or beverages that may cause stains or lingering odors is strongly discouraged.
-
Prohibited Items: The consumption of alcohol, tobacco products (including e-cigarettes), and illegal narcotics within any Indus Cab vehicle is strictly prohibited by law. Transporting hazardous materials, firearms, or illegal contraband will result in immediate termination of the ride and notification to local authorities.
-
Respectful Behavior: Verbal abuse, physical aggression, or harassment of our chauffeurs will not be tolerated. Drivers have the right to terminate a trip immediately if they feel threatened or if a passenger engages in inappropriate conduct.
-
Damage Liability: If a passenger, or their accompanying guests/pets, causes physical damage or soils the interior of the vehicle (e.g., vomiting, tearing upholstery), the passenger will be liable for a standard “Cleaning and Damage Fee” ranging from ₹1,000 to ₹5,000, depending on the severity of the damage.
Luggage and Personal Belongings
-
Capacity Limits: Passengers must adhere to the standard luggage capacity of the booked vehicle category. Chauffeurs reserve the right to refuse excessively heavy or oversized items that jeopardize the safety of the vehicle or obscure the driver’s visibility.
-
Lost and Found: Passengers are entirely responsible for their personal belongings. While Indus Cab will make every reasonable effort to locate and return items left behind in our vehicles, we assume no financial or legal liability for lost, stolen, or damaged personal property during or after a ride.
Limitation of Liability and Disclaimer of Warranties
-
“As Is” Service: The Services are provided on an “as is” and “as available” basis. Indus Cab expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
-
Service Delays: We do not guarantee that your journey will be completed within a specific timeframe. We are not liable for missed flights, delayed meetings, or any indirect, incidental, or consequential damages arising from traffic congestion, vehicle breakdowns, or route diversions.
-
Maximum Liability: In no event shall Indus Cab’s aggregate liability for any claims arising out of this Agreement or your use of the Services exceed the total fare paid by you for the specific ride giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Indus Cab, its directors, officers, employees, affiliates, and contracted drivers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of our Services; (b) your breach or violation of any of these Terms; or (c) your violation of the rights of any third party, including our drivers.
Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India.
Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or invalidity thereof, shall first be subject to good-faith negotiations between the parties. If the dispute cannot be resolved amicably within thirty (30) days, it shall be subject to the exclusive jurisdiction of the competent civil courts located in Ranchi, Jharkhand.
Modification of Terms
Indus Cab reserves the right, at its sole and absolute discretion, to modify, amend, or replace these Terms at any time to reflect changes in our operational policies, legal requirements, or service offerings. Any material changes will be communicated via email or through prominent notifications on our platform. Your continued use of the Services following the posting of updated Terms constitutes your binding acceptance of the revised Agreement.
